These terms apply when you use ecologicalelegance.au, purchase products, or book a workshop or farm experience through the website. By placing an order or booking, you agree to these terms.

The website and business are operated by Ellen Thompson trading as Lavender Goat Farm, ABN 11 797 382 872, at 456 Cygnet Coast Road, Petcheys Bay, Tasmania 7109. Ecological Elegance is the brand used on this website.

Using the website

You must use the website lawfully and must not interfere with its operation, attempt unauthorised access, introduce malicious code, or use its content in a way that infringes another person's rights. Purchases and bookings must be made by a person aged 18 or over.

Products and information

We aim to describe and photograph products accurately. Because products are made in small batches and may contain natural materials, colour, scent, texture and appearance may vary slightly. Screen settings may also affect how colours appear. These variations are not necessarily defects.

Read product descriptions, ingredient lists, labels and directions before purchase and use. Stop using a product if irritation occurs and seek appropriate medical advice. Website content is general information and is not medical advice.

Prices payment and orders

Prices are stated in Australian dollars. Any delivery charges and applicable taxes will be shown at checkout. Payment must be authorised through the available checkout method before an order or booking is confirmed.

An automated acknowledgement does not require us to accept an order. We may decline or cancel an order before dispatch if a product is unavailable, a price or description contains a genuine error, payment is not authorised, or we reasonably suspect fraud. If we cancel after receiving payment, we will refund the amount paid for the cancelled item or booking.

Product availability

Products are subject to availability. If an item becomes unavailable after you order it, we will contact you and offer an available alternative, a later dispatch date or a refund. We will not substitute a materially different product without your agreement.

Delivery

Available delivery destinations, charges and estimated timeframes are shown at checkout. Timeframes are estimates and may be affected by carriers, weather, seasonal demand or events outside our reasonable control. Please provide a complete and accurate delivery address.

Contact ellen@ecologicalelegance.au promptly if an order arrives damaged, is incomplete, or has not arrived within a reasonable time after the estimated delivery date. We will investigate with the carrier and provide any remedy required under Australian Consumer Law.

Returns refunds and consumer guarantees

We do not accept returns or provide refunds solely because you change your mind. This does not affect your rights under Australian Consumer Law.

Our goods and services come with consumer guarantees that cannot be excluded. If a product is faulty, unsafe, materially different from its description, or otherwise fails a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances. Contact ellen@ecologicalelegance.au with your order details and a description or photograph of the problem before returning an item. We will provide return instructions and meet any reasonable return-cost obligation required by law.

Workshop and farm experience bookings

You may cancel a workshop or farm experience for a refund or transfer to another available date by giving at least 48 hours' notice by email. Cancellations made less than 48 hours before the scheduled start time are non-refundable and cannot be transferred, except where required by law.

If we cancel an experience, including because of unsafe weather, farm conditions or circumstances outside our reasonable control, you may choose a transfer to another available date or a refund of the booking price. We are not responsible for separate travel or accommodation costs unless required by law.

Visitors must follow reasonable safety directions, wear suitable clothing and footwear, supervise children in their care, and tell us before the experience about relevant accessibility needs, allergies or health considerations. A farm is a working environment with uneven ground, animals, plants, tools and changing weather conditions.

Intellectual property

Unless otherwise stated, the text, product names, branding, graphics and other original website content are owned by or licensed to us and are protected by applicable intellectual property laws. You may view or print website content for personal, non-commercial use. You must not reproduce, sell, modify or commercially exploit it without prior written permission, except as permitted by law.

Third party services and links

The website may use or link to services operated by third parties, including payment and delivery providers. Their own terms and privacy practices may apply. We are not responsible for third-party websites or services that we do not control, but this does not limit any responsibility that cannot lawfully be excluded.

Website availability and liability

We aim to keep the website accurate, secure and available, but do not guarantee uninterrupted access or that every error will be corrected immediately. To the extent permitted by law, we are not liable for indirect or consequential loss arising solely from website interruption, third-party systems or misuse of the website.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Privacy

Our Privacy Policy explains how we handle personal information collected through the website, orders, bookings and enquiries.

Changes to these terms

We may update these terms from time to time. The version published when you place an order or make a booking will apply to that transaction, unless a change is required by law.

Governing law and contact

These terms are governed by the laws of Tasmania and the Commonwealth of Australia. The courts and tribunals of Tasmania have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable law.
